Carer's Leave In Australia
Carer’s leave allows employees to take time off from work to take care of an immediate family or household member who is unwell or injured, or to help with a family emergency. This does not mean that an employer must provide the employee with additional leave, above what they are already entitled to.
All employees, except casual employees, are entitled to 10 days of paid personal leave per year.
Both sick leave and carer’s leave come out of the balance of personal leave that an employee accumulates. According to an employee’s ordinary hours of work, his entitlement to personal leave accrues progressively throughout the year, from the employee’s first day of work. Whenever it is necessary, an employee is entitled to take his personal leave as carer’s leave to provide care or support to an immediate family or household member.
An immediate family member can be the employee’s:
- Spouse
- De facto partner
- Child
- Parent
- Grandparent
- Grandchild
- Sibling
- The immediate family member of the employee’s spouse or de facto partner
An employer is entitled to ask for evidence that the leave was taken due to the need to provide care or support to the employee’s immediate family or household member. Apply for your leave certificate here.
Two commonly accepted forms of evidence are medical certificates and statutory declarations stating their requirements. An employee must give the employer as much notice as possible of their intention to take carer’s leave, and how long they expect to be off work.
When an employee has run out of paid personal leave, he is entitled to two days of unpaid carer’s leave. In addition to personal leave, employee’s, not including casual employee’s, are also entitled to two days of paid compassionate leave, where an immediate family or household member contracts or develops a personal illness, or sustains a personal injury that poses a serious threat to their life, or worse still, passes away. Casual employee’s are entitled to unpaid compassionate leave also on this basis.
